CARPINTERIA, CALIF. — Santa Barbara Restaurant Group Inc., a subsidiary of CKE Restaurants Inc., sold its 100-percent equity interest in Bloomington, Minn.-based Timber Lodge Steakhouse Inc. to T-Lodge Acquisition Corp. for approximately $8.8 million, according to company officials. T-Lodge Acquisition Corp. is a privately held company owned by members of the management team of Timber Lodge as well as other investors.

The number of new single-family homes under construction in El Paso County fell for the second straight month in February, but industry officials arent fretting yet. Construction began last month on 584 single-family homes - down 12 percent from the 664 homes started in February 1999. Combined with Januarys figures, which also declined from the previous year, single-family housing starts for the first two months of 2000 in the county were down 11.5 percent over the same period in 1999.
WASHINGTON — The housing market is still booming, with construction of new homes rising 0.2 percent in May. Builders rushed to break ground on new projects to meet strong demand fueled by low mortgage rates. While the May increase was slightly below the 0.6 percent gain that had been forecast, economists blamed a decline in the South on the temporary effect of unusually wet weather in Florida and other parts of the South. They noted that permits for new construction, a key indicator of future strength, came in at a solid annual rate of 2.050 million units. “We still have a red-hot housing market,” said David Seiders, chief economist of the National Association of Home Builders. “Surveys of both lenders and builders are showing tremendous ongoing strength with little or no hints that anything is starting to fall.”
In an otherwise unstable economy, the housing market has remained strong, with exceptionally low mortgage rates encouraging many to buy homes, driving up home prices, and enabling homeowners to refinance existing mortgages at lower rates. Even though many analysts believe that the mortgage rates bottomed-out in mid-June and the refinancing boom may have ended, rates are still low by historical standards, and although it is slower, the demand for housing is still present.

BARTOK Royal Philharmonic / Gatti Conifer 75605 51324 2 Nothing if not a confident choice with which to celebrate your new orchestra, your new recording contract. If youve a mind to show off, then you do so in the best of company with Bartoks Concerto for Orchestra. Characteristically, though, Gattis Bartok is more about drama than display. And thats more of a novelty than you might think. Bartok so often gets left behind in performances of the Concerto. So often its about sound not because of sound. So often the music is subsumed by the special effects. The shows the thing. Not here. Gattis “Introduzione” at once opens magic casements on to the concerto beyond. Muted string tremolandi are drawn like a veil over the opening pages, the violas sul ponticello adding a touch of frost. The solo flute is pale and very interesting. Not a bar, not a note goes by that doesnt convey something. The intrigue of a first encounter, thats the spirit. So those little oboe and/or clarinet and harp diversions in the first movement come on like ancient airs and dances; so there is nothing remotely faceless about the woodwind “couplets” of the second movement; so the third movement “Elegia” stretches and intensifies the dynamic possibilities, suggesting a lake of tears to shame even Bluebeard, with ardent violins pulling more sound up from their bottom strings than Ill wager even they thought they had. When did you last hear the cor anglaiss plangent canon to the lyric main theme of the “Intermezzo interotto” sound this purposeful? And since when did Till Eulenspiegel get to play tag with the Shostakovich “Leningrad” theme? All right, so the finale sacrifices fire to the rustico character of the music (presto? hardly), so youre listening to the Royal Philharmonic thinking of the Chicago Symphony. But theres more music being made here than in the average Concerto for Orchestra - and thats a fact. The Divertimento, meanwhile, is further testament to Gattis work in progress with the RPO strings. Folk dance and fiddling are at the heart of this piece, the character once again dictating the sound. Which is just as it should be and so rarely is. Edward Seckerson

His production role has been shaped by his extensive terms of reference. “I travelled all round central Africa with my parents, and when I was in Paris I collected all these Cuban records, along with soul and other styles, and I think I bring this to artists. “With Baobab in the Seventies, everyone was doing rumba, but I was the man who actually had the huge record collection and was able to point them in the right direction. Salif Keita was looking for something revolutionary, so I suggested putting him in touch with someone from the West who had the same avant-garde approach. That was Francois Breant - and basically I let them get on with it.”

Exercise and Cancers: Research Opportunities for Health-Related Fitness ScientistsRepresentatives from the American Cancer Society (ACS), the National Cancer Institute (NCI), and the Centers for Disease Control (CDC) will challenge AAHPERD members to contribute to cancer prevention and control, describing the most promising research opportunities and resources to support investigation of the relationships between cancers and exercise. The presentation will be based on a synoptic article being developed by the ACS and the Office for Health Promotion of Northern Illinois University. Ruth Corcoran of ACS will describe a proposed collaborative research agenda, suggesting that two sets of consensually developed guidelines are needed to promote such research: one set to facilitate dissemination of what experts already know to the public and providers (including exercise specialists); and a second set to facilitate further collaborative research. Speakers from CDC and NCI will outline what is known about these topics, and how exercise scientists can contribute to further development (see accompanying abstracts). Presenters will recommend a process to develop research priorities, involving cancer experts, public health scientists, and relevant interest groups in AAHPERD. It showcases a variety of new, gently used and discontinued home office and commercial furniture, as well as refurbished copiers and fax machines, said Rachel Stoops, who is managing the store. “All the furniture in the front of the store will be new, along with some barely used pieces that come from the main showroom. Some of the furniture in the warehouse will be from jobs we do, but not much is in the way of trade-ins.”

The upswing in the economy has meant better business for office furniture and equipment dealers this year. However, some dealers around the county say that some businesses are still looking for ways to stretch a buck when buying for the office. According to the Business and Institutional Furniture Manufacturers Association, office furniture buying in the United States shrank in 2001, 2002 and 2003. The association expects to see a 5.1 percent increase in sales this year and is projecting a 9.3 percent increase next year, the best since 2000.

Real Estate Investment Trusts (REITs) are essentially closed-end real estate funds. They invest in commercial, office and/or residential properties. REITs typically generate high income (10%-to-15%) and some provide even higher returns. Because of their high yields, REITs are currently very popular. Lately, some REITs have been yielding over 10%. In recent years, investing in most real estate projects has generated very handsome returns. Other than the office markets in some high-tech areas, the returns on real estate have far exceeded the returns on all other investment categories. TWO new NHS dentists are set to be recruited in Whitley Bay. The move is as part of pounds 300,000 investment by North Tyneside Primary Care Trust to improve access to NHS dentistry in the borough. Details on how patients will be able to access the services will be announced once the dentists have been appointed. Chief executive Chris Reed said: Im really pleased to announce this additional investment in NHS dentistry for North Tyneside.
Politicians are polishing up their information about local dentist services. Liberal Democrats in Gateshead and Washington have launched a survey of dental care. Low Fell councillor Frank Hindle is co-ordinating the survey.

FEAR of exploitation and degradation is what inspired Congress in 1872 to set aside 2.2 million acres in three states to preserve the unique volcanic region known as Yellowstone as the worlds first national park. President Ulysses S. Grant signed the measure declaring that the sensitive area, with its roaring geysers and bubbling mud, would forever be set apart “for the benefit and enjoyment of the people.” Sadly, the short shrift given to Yellowstone, that grand old patriarch of parks, is symptomatic of a neglectful policy being applied to our national treasures across the board. At a time of war and tax cuts and huge deficits, something has to give. And under a spending bill recently approved by the House, a big loser is clearly the nations parks, already woefully underfunded.
In 2004, the EMS team identified its first large-scale initiative–solid waste management. Some of the guidelines introduced include: * Recycling opportunities for visitors. There are currently 63 recycling bins in the park, and it is estimated that there has been a 50 percent increase in the amount of commodities collected in the park, particularly plastics. * Recycling propane cylinders. Through a partnership with Grand Teton National Park, Yellowstone and Grand Teton concessionaires, the Yellowstone Park Foundation and various private entities, there is now a program of collecting and recycling propane cylinders in the greater Yellowstone area. The Propane Bottle Recycler (PBR), a mobile propane recycling unit, is now being used to recycle the estimated 3,000, one-pound propane cylinders discarded in the park each year.

Real estate practice is a broad and widely defined area of the law. In a pristine sense it deals with the esoteric subject of real property law and titles. In practice the subject matter handled by real property lawyers is much broader. Many of the areas of law within real estate practice are areas of specialty themselves. Real estate lawyers examine and evaluate real property titles, handle real estate sales, purchases and other transactions, foreclose mortgages, represent developers and contractors in drafting and negotiating development and construction agreements, handle real estate financing, structure and draft the governing documents for planned developments such as condominiums, serve as counsel to community and condominium associations, draft and negotiate leases, litigate title, boundary, and other land disputes, and advise clients respecting zoning and land: use matters. The examination of real estate titles requires knowledge of corporations and other forms of business organization, wills, trusts and estates, and a practitioner handling transactions must understand contractual, business, and tax subjects as well. The subjects that are tested on the certification exam attest to this diversity. They are title issues; real estate finance; environmental and land use; condominiums and homeowner associations; landlord tenant; closings; sellers, buyers, brokers, and title insurers; real property litigation; taxation of entities and other tax issues; and ethics. Some hold an impression that at least some aspects of the real estate practice are not challenging, that the practice is increasingly title company, form, and paralegal driven, and that when business is light any lawyer with a good paralegal can Ado real estate closings. This impression is not accurate. As with any area of practice, successfully representing clients in real estate matters requires knowledge, skill, and experience. The diversity in real estate practice may mean that no one lawyer can be an expert in each practice area encompassing the modern real property practice or that are tested by the certification program. That, however, is not a reason to not seek certification. The committee recognizes that few lawyers are likely to possess specific and detailed expertise in each of the many subjects that fall within the scope of real estate.

With the warmer weather coming, there will be a noticeable increase in demand for camcorder videotape, says director of marketing Peter Brinkman. He adds that retailers that add 8mm and VHS-C blank tapes to their seasonal sections tend to see higher impulse sales than those who dont. Brinkman points out that the number of United States households that have at least one camcorder continues to grow at a brisk pace, creating more opportunities in the blank tape category. As is the case in the audio segment, the category is feeling the influence of new formats, including the popular Hi8mm format. What we have seen over the past few years is that consumers feel very comfortable buying their blank media at chain drug stores, so its a good idea to be ready, he says.

In his preface he relates that the present work is intended to offer a background set of principles and to review state-of-the-art techniques of diagnosis and treatment in SCI care. The management of persons with SCI is outlined clearly in the first four chapters. Chapter 1, Principles of SCI, reviews anatomy of the spinal cord and briefly mentions problems and goals of care phases of SCI. Chapter 2, Acute Care, covers neurologic and orthopedic aspects of SCI and treatment approaches to minimize further injury and complications. Chapter 3, Rehabilitation, classifies impairments of sensation, motor function, micturition, defecation, sexual function, autonomic function, skin, and breathing. The management of these impairments, with the goal of minimizing disability, is outlined. Problems that might be faced in continuing care, such as posttraumatic syringomyelia, spasticity, and pain, are focused on in Chapter 4. The fifth and last chapter of this book, Participatory Planning, emphasizes involving the patient in goal setting and presents approaches for the planning process. The authors intended audience-physicians working with patients with SCI (particularly residents in neurology and rehabilitation medicine), physical therapists, occupational therapists, nurses, and others seeking a basic introduction to SCI-certainly will find this work useful. Other texts, including those listed in the references at the end of each chapter, would be better resources for more detailed information on the management of persons who have SCI. Physical therapy practitioners and other health care professionals would find the chapter on participatory planning particularly interesting and valuable.
Personal Injuries follows The Laws of Our Fathers, which Turow completed in 1996. His latest novel is set in the fictional Kindle County, which has much of the atmosphere and many attributes of Chicago, the city in which Turow and his wife practice law. The IRS has located a bank account into which large amounts of money have been deposited by those associated with a small law firm. The account appears to be a device to hide income, and the IRS immediately puts the pressure on Robbie Feaver, one of the two partners in the firm. The real problem for Feaver began when the IRS agents opened his front door to let in U.S. Attorney Stan Sennett, who had an entirely different goal than tax recovery on his mind. That is when George Mason got involved. Mason was an attorney who had an office in the same building where Feavers firm had its offices. Mason becomes the voice of the novel as Feavers attorney for the defense of the tax fraud charges. The story is told largely from his point of view as he attempts to help Feaver through what becomes a complicated hodgepodge of personal relationships, schemes, double-dealing, subterfuge and, ultimately, death. It seems the U.S. Attorney is interested in leveraging the potential tax charges against Feaver to force Feavers cooperation in a sting operation. The target of the sting is Feavers law partners uncle, the chief judge of the local court. U.S. Attorney Sennett believes there is widespread corruption in the courts. Feaver confirms that he has been involved in a system by which he can influence the outcome of cases favorably. The system involves giving money to various people who work for different judges, and the belief is that some of the money in each case makes its way to the chief judge.
Taxation of Personal Injury Awards Recent legislation, as part of the Revenue Reconciliation Act of 1989, may have settled some of the other areas of disagreement. The legislation provides that the exclusion for personal injury awards does not apply to any punitive damages in connection with a case not involving physical injury or physical sickness.(1) Thus, it would appear that all damages, both compensatory and punitive received for physical injuries will be excluded from gross income. Only compensatory damages received for non-physical injuries will be excludable from gross income. Punitive damages received for non-physical injuries will be taxable. The new provision is effective for amounts received after July 10, 1989, in tax years ending after that date, unless a binding agreement, decree or award is in effect before then. Despite the clarifying legislation, areas for disagreement between taxpayers and the IRS still exist regarding the nature of non-physical injury awards involving libel or defamation of character. Lets examine the statutory provisions, administrative pronouncements and judicial interpretations affecting the taxation of awards for libel or defamation of character.

Statement on Auditing Standards No. 54 requires the independent auditor to recognize major illegal acts, and in some instances report them. Legislation pending in the U.S. Congress may mandate even tougher standards.To meet their ever-expanding responsibilities in the area of fraud deterrence, internal auditors must be more “fraud-savvy” than ever before. REFINANCED GRANDFATHERED DEBT QUADS AS grandfathered debt if the mortgage proceeds do not exceed the balance of the old mortgage prior to refinancing. Home mortgage interest expense is deductible if certain requirements are met. In general, mortgage interest expense is deductible only if the home is collateral for the debt (secured debt). If the borrower cannot pay the debt, the lender can use the home to satisfy the loan. Interest expense paid on home acquisition debt, home equity debt, and grandfather debt is generally considered deductible. A mortgage taken out after October 13, 1987, to acquire, build, or substantially improve a qualified residence is classified as home acquisition debt. Qualifying debt is limited to $1 million ($500,000 each for married filing separately). The $1 million limitation is reduced (but not below zero) by any grandfathered debt. If home acquisition debt is refinanced, the new debt will qualify as home acquisition debt only up to the balance of the old mortgage prior to refinancing. The interest attributable to the additional debt will be nondeductible personal interest unless it qualifies as home equity debt.

CHRISTMAS shoppers will welcome the news that Barclaycard has teamed up this week with 17 retailers to offer discounts of 10 per cent or more to cardholders who use their Barclaycard for Christmas shopping. The retailers hope to persuade shoppers to spend money before Christmas rather than waiting for the sales. The offer should also help boost Barclaycard, whose share of the credit card market has been dropping steadily. This is not the first time credit cards have offered cashbacks and discounts instead of points and air-miles. Goldfish, the credit card run by British Gas and HFC Bank, offers users discounts on gas and electricity bills from British Gas Trading, or the chance to set savings against BT bills and the TV licence. It offers points for each pound spent, which can be swapped for vouchers at Asda, MS and Boots. Alliance Leicester broke new ground last March with their Moneyback credit card, offering a rebate of 0.5 per cent on spending up to pounds 3,000 a year, rising to 1 per cent on anything over that. In January, 400,000 cardholders will get average rebates of pounds 25. On top of that, eight retailers, including BP, MFI and Currys, give cardholders instant discounts equal to the rebates from the Alliance. The incentive seems to work: cardholders use their card 12 times a month, four times the industry average. The Birmingham Midshires discount card launched this year offers tiered cashbacks ranging from 0.33 per cent up to pounds 3,000 a year, to 0.75 per cent and then 1 per cent on spending over pounds 7,000. In May the Amex Blue card launched, offering 1 per cent cashback off the value of all purchases made with the card, which will rise to 5 per cent next month only. The annual pounds 12 fee takes a little icing off the cake. Barclaycards campaign ends on Christmas Eve. If it wins extra business for the retailers and Barclaycard it may lead to something more permanent. The other cashback cards may also decide to improve and extend their offers. Financial Statement Disclosures for Financially Troubled Enterprises Readers of financial statements of companies operating under chapter 11 generally recognize the financial statement disclosures required by the American Institute of Certified Public Accountants (AICPA) Statement of Position 90-7, “Financial Reporting by Entities in Reorganization Under the Bankruptcy Code” (SOP 90-7). As required by SOP 907, financial reporting during reorganization proceedings should distinguish transactions and events that are directly associated with the reorganization from those related to a debtors ongoing business operations. The distinction between the reorganization and the ongoing business is made on each of the debtors principal financial statements. Certified Fraud Examiners, many of whom have an audit background, are required to resolve allegations of fraud. Statement on Auditing Standards No. 53, promulgated by the Auditing Standards Board of the American Institute of Certified Public Accountants, requires external auditors to be more proactive in searching for fraud. Statement on Auditing Standards No. 54 requires the independent auditor to recognize major illegal acts, and in some instances report them. Legislation pending in the U.S. Congress may mandate even tougher standards.To meet their ever-expanding responsibilities in the area of fraud deterrence, internal auditors must be more “fraud-savvy” than ever before. During the last five years, Ive conducted interviews with McKinley Tabor and a few dozen other offenders. There is a lot we can learn from these financial Frankensteins.

Symposium: Theoretical Basis and Effectiveness
Exercise and Cancers: Research Opportunities for Health-Related Fitness ScientistsRepresentatives from the American Cancer Society (ACS), the National Cancer Institute (NCI), and the Centers for Disease Control (CDC) will challenge AAHPERD members to contribute to cancer prevention and control, describing the most promising research opportunities and resources to support investigation of the relationships between cancers and exercise. The presentation will be based on a synoptic article being developed by the ACS and the Office for Health Promotion of Northern Illinois University. Ruth Corcoran of ACS will describe a proposed collaborative research agenda, suggesting that two sets of consensually developed guidelines are needed to promote such research: one set to facilitate dissemination of what experts already know to the public and providers (including exercise specialists); and a second set to facilitate further collaborative research. Speakers from CDC and NCI will outline what is known about these topics, and how exercise scientists can contribute to further development (see accompanying abstracts). Presenters will recommend a process to develop research priorities, involving cancer experts, public health scientists, and relevant interest groups in AAHPERD. LEWISTON, Idaho — Lisa Benner and her horse are endurance athletes. They covered 100 miles across the Sierra Nevadas in less than 24 hours, and now theyre training to do it again. “Its you against the clock,” Benner said of the difficult competition. “To finish is to win.” When the Western States Trail Ride began at 5:15 a.m. near Truckee, Calif., 196 horses thundered into the mountains, but only 87 crossed the finish line at Auburn, Calif. within the allotted time. The 44-year-old woman and her Arabian, Jack, finished in 23 hours, 33 minutes.
SOUTH JORDAN — The 2004 Utah Horse Expo will be held this weekend at the Salt Lake County Equestrian Center in South Jordan. The event will feature seminars, horse shows, horse trainers and experts along with the latest in horse products and services. The Horse Expo will be open today, 10 a.m.-9 p.m., and Sunday, 10 a.m.-5 p.m.
She said the affected horses are showing no symptoms. The center includes 17 barns housing 400 racehorses. Only one barn was affected.

LAS VEGAS — Combining liposuction with Thermage–a radiofrequency energy system that heats the skin to produce collagen tightening and shortening–led to clinically significant tightening of abdominal skin at 28 weeks, compared with either treatment alone, results from a small study suggest. Combining the two procedures can be particularly useful in patients with loose skin or striae prior to liposuction, David Avram, M.D., said at the 13th International Symposium on Cosmetic Laser Surgery. This can be a way of enhancing our results in those patients. However, this was a small study. We obviously need to perform more studies with more patients. For the study, Dr. Avram and his associates treated 14 patients with standard tumescent liposuction plus Thermage (group 1), four patients with liposuction only (group 2), and two patients with Thermage only (group 3). After liposuction, patients in group 1 had four tattoo markers placed in a rectangular pattern in areas of loose abdominal skin. The area was calculated and recorded prior to treatment with Thermage, said Dr. Avram, a cosmetic dermatologist who practices in New York City.

Its a very common problem.The body, Sireci said, has thousands of dormant hair follicles that become active through puberty, pregnancy and menopause as well as through certain medications.As for those clients who find electrolysis painful, Sireci recommends topical ointments that take the edge off.Sireci used her personal savings to open her facility, including thousands for a treatment table. Although the traditional fragrance business continues to struggle in both prestige and mass market retail venues, there are signs that the category may be destined for better days. Breaking the responses down by age group, 75% of Generation Y women bought perfume in 2003 compared with 62% the year before, while Generation X purchasers increased from 60% in 2002 to 71% last year.
